I am signing a commercial lease. Who looks after the asbestos?
The legal responsibility for the asbestos, within a property falls on the ‘dutyholder’.
This is usually the owner or maintaining tenant, if you sign the lease and are required to look after the maintenance of the property.
The responsibility to look after the asbestos is then yours. It is not unusual for tenants on long leases who are exiting the lease to be faced with a large bill to ‘make safe’ or repair an asbestos roof which has deteriorated over that time.
You can sign a lease but exclude specific aspects such as ‘the roof’, so it stays as the Landlords responsibility.
If you sign the lease and have to maintain the asbestos then you would be expected to formulate a management plan and have the materials inspected regularly to ensure they are safe.
