The use of asbestos in the UK was banned in 1999, yet worryingly the substance is still associated with thousands of deaths each year. All commercial (non-domestic) properties built before 2000 are legally required to have an appropriate asbestos survey. Any asbestos within the property must be managed and re-inspected on a regular basis. Do I need a certificate to prove that I have had asbestos training?

This is not a legal requirement, but is a good way of demonstrating you have received appropriate asbestos training. Most organisations will ask to see certification.

Do I need a risk assessment before I start work on asbestos?

Both a risk assessment and method statement are required before work on asbestos begins. On top of this, it is key to remember that only trained or licensed people can work on asbestos .

What is the 'duty to manage' asbestos and who has it?

The ‘duty to manage’ is a legal duty imposed on the person that owns or maintains - usually via a lease - a property that contains asbestos. If this applies to you, you’ll need a written plan detailing how you will protect people occupying the building and those that come to work in the building, from asbestos. This plan will need to be reviewed annually, and the asbestos materials will require to be re-inspected by a competent person. Can you claim tax relief on the removal of asbestos?

Under the UK Finance Act 2001, there is a section known as Land Remediation Relief. You can claim up to 150% capital relief on money spent remediating asbestos from land and buildings.
